The court also heard on May 11 that he was in custody for aggravated burglary and had a release date of February 2025.
Sgt Kelly said it was unclear whether the accused was driving that day.
Defense attorney Tim Kennelly said the 36-year-old had addiction issues.
Mr Kennelly said the man also had a child and found it ‘exceptionally difficult’ to be away from the child.
He also said the defendant would use his landscape gardening skills once he was released and he said he did landscape gardening in prison.
He asked Judge Desmond Zaidan not to add anything to his prison sentence.
Judge Zaidan then asked the defendant if he had any advice on landscaping, to which the defendant replied “I should see the garden first”.
Judge Zaidan imposed an 11-month custody sentence.
